The petitioner seeks bail in connection with Rashulpur P. S. Case No. 36 of 2019 registered under Sections 341, 323, 324, 504, 307 and 379/34 of the Indian Penal Code. Learned counsel for the petitioner submitted that that there is case and counter case. In free-fight between the parties, members of both sides sustained injuries. The injury alleged to have been caused by the petitioner to Shital Giri were found all simple in nature.
Patna High Court CR. MISC. No.30098 of 2019(2) dt.23-05-2019 2/3 Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the statement made in para-3 of the application that the petitioner has got no criminal antecedent, since the injuries found on the person of Shital Giri were simple in nature caused by hard and blunt substance, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM-X, Saran at Chapra in connection with Rashulpur P. S. Case No. 36 of 2019, subject to the following conditions:- (a) that the petitioner shall attend court in accordance with the conditions of the bond executed;
(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to
