====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 396 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. Lastly, the prayer for grant of bail to the petitioner was rejected by this Court vide order dated 21.03.2024 passed in Cr. Misc. No. 70824 of 2023 with an observation to expedite and conclude the trial preferably within a period of one year.
4. Learned counsel for the petitioner submits that pursuant to the direction of this Court, the trial has not been concluded till date and the same is pending for examination of prosecution witnesses. In this case, charge has been framed on 28.11.2019 and the petitioner is in custody since 18.03.2019.

5. Considering the aforesaid facts and circumstances of the case and period of custody and tardy process of trial, the prayer for grant of bail to the petitioner is allowed.
6. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Sessions and District Judge-I, Sherghati, Gaya in connection with S.TR No. 379/19/26/22 arising out of Barachatti P.S. Case No. 119 of 2019.
