====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 25-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the Vigilance.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

3. The allegation in the FIR is that the petitioner had secured his appointment as Block Teacher in the year 2015 on the basis of fake and forged marksheets/certificates of BETET.

4. Learned counsel for the petitioner submits that the petitioner has been serving regularly from 2015 to December, 2024 without any grievances from the school department, however, without proper verification, the petitioner is being penalised. It is further submitted that vide Annexure-2, the

Patna High Court CR. MISC. No.30990 of 2025(4) dt.25-07-2025 2/2 services of the petitioner has already been terminated from the post of Teacher and such statement has also been made in paragraph 11 of this petition.

5. Learned APP for the State and learned counsel appearing for the Vigilance, however, oppose the prayer for anticipatory bail.

6. Considering the fact that the petitioner has already been terminated from the service, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Sangrampur P.S. Case No. 09 of 2025, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.
