2. The present application has been filed:
for quashing the Order dated 30th September, 2016 passed by the Bihar Land Tribunal (Shortly put as B.L.T) in Patna in B.L.T Case No. 768/2015 under which the Learned Chairman of the B.L.T (Bihar Land Tribunal) dismissed the application filed by the petitioner by holding the land is not agricultural rather homestead, order by committing an error of record and law affirming the order passed in revision in view of the facts and circumstances stated

3. Learned counsel for the petitioner submits the case has become infructuous, the petitioner is dead and in that background, he may be permitted to withdraw the petition.
4. Granting said liberty, the writ petition is dismissed as withdrawn.
