JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2018 The petitioner is apprehending his arrest in connection with Arwal P.S. Case No. 77/18, registered for offences punishable under Sections 387/34 of the Indian Penal Code. Allegation against the petitioner and other co-accused of this case is of demand of Rangdari from the informant and specific allegation against this petitioner that he threatened the informant on phone.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and there is no allegation against him of demand of Rangdari and the allegation that he threatened the informant on phone is false and concocted. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.48418 of 2018 (2) dt.24-08-2018 2/2 circumstances of the case as well as the fact that petitioner is an accused in three other cases; I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if the petitioner surrenders before the court below within a period of six weeks and pray for regular bail, the court below shall consider the same on the merit of the case without being prejudiced by the order of this Court.
