1. The Writ petition is filed for quashing of the Notice under Memo No. 338 dated 13.09.2001 issued by the Deputy Development Commissioner, East Champaran, Motihari whereby the petitioners were directed to deposit outstanding amount of rent of shops of Zila Parishad positively till 13.10.2001 and in case of non-payment of outstanding rent, their allotment/settlement would be cancelled and by locking the shops, steps for recovery of the amount would be taken.

2. The Learned counsel for the respondent reported to the Court that pursuant to the Notice, the allotment of shops of Zila Parishad were cancelled and they were allotted to the third party. Therefore, the Writ petition becomes infructuous.

3. Taking into consideration that the Writ petition itself is filed for quashing of Notice and
