JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2018 This modification petition has been filed by the informant (petitioner herein) making apprehension that in the event he makes payment of Rs. 22 lacs to petitioner no. 1 and petitioner no. 1 does not execute the sale deed in favour of the informant (petitioner herein), then he will be put to harassment and further litigation.

The prayer has been made by the learned counsel for the informant that he may be allowed to make payment of Rs. 22 lacs by Bank draft in the court of learned Chief Judicial Magistrate, Bhagalpur. Petitioner no.1 will be entitled to receive the demand draft after execution of sale deed in favour of informant.

This Court after looking into the order dated 26.04.2018 passed in Cr. Misc. No. 12709/2018 finds that the order is very clear and speaking. All the terms and conditions has

Patna High Court Cr.Misc. No.48925 of 2018 (2) dt.08-08-2018 2/2 been clearly explained and clarified in the aforesaid order. Therefore, this Court does not feel necessity to modify the aforesaid order, i.e. 12709/2018 dated 26.04.2018. However, it is observed that after making payment of Rs. 22 lacs to the petitioner by demand draft the sale deed will be executed by petitioner within time as ordered earlier. With the aforesaid observation, this modification petition is disposed of.
