JUSTICE BIRENDRA KUMAR ORAL ORDER 08-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Bikram P.S. Case No.202 of 2016, registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

It appears that prayer for anticipatory bail to the petitioner was refused vide Annexure-1 in connection with Bikram P.S. Case No.202 of 2016 on 21.06.2017 vide order passed in Cr. Misc. No.9709 of 2017. Neither the petitioner has surrendered nor was apprehended by the police uptil now even after lapse of more than a year. New ground for review of the prayer is mentioned in para-11 of the petition, which is in the nature of subsequent

Patna High Court Cr.Misc. No.46717 of 2018 (2) dt.08-08-2018 P2/ development.

The same shall be considered by the learned Courtbelow while considering the prayer for regular bail in the event of surrender of the petitioner within three weeks from today. Failing which the Court-below shall be at liberty to pass appropriate order according to law.
