1. Heard learned counsel for the petitioner and learned counsel for the opposite parties.
2. This application has been filed praying for quashing the order taking cognizance dated 15.11.2021 in connection with Sonbarsa P.S Case no. 4 of 2019 by the learned Additional Chief Judicial Magistrate-VII, Sitamarhi.
3. At the outset, learned counsel for the opposite party no.2 referring to the certified copy of the orders of the learned trial Court submits that trial has commenced in the learned trial
Patna High Court CR. MISC. No.30646 of 2022(5) dt.13-05-2024 2/2 Court and three witnesses have already been examined on behalf of the prosecution.

Having gone through the certified copy of the ordersheet of the learned trial Court, learned counsel for the petitioner prays for withdrawal of this application with liberty to raise all the points raised in the instant application as also available to the petitioner in course of trial at the appropriate stage.
5. This application stands disposed of as withdrawn with the aforesaid liberty.
