2. The petitioners seek bail in Banka P.S. Case No. 393 of 2025 registered for the offences punishable under Sections 103(1), 238(2) and 3(5) of the BNS.
3. The allegation is that the brother of the informant had gone to the house of Bhola Jha and thereafter his dead body was recovered. Thus, the allegation is against Bhola Jha.
4. Learned counsel for the petitioners submits that the petitioners are the father and mother of Bhola Jha respectively. The allegation at best against them is that they did not tell the
Patna High Court CR. MISC. No.29995 of 2026(2) dt.06-05-2026 2/3 informant regarding the whereabouts of the deceased.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioners.
6. Considering that the petitioners are in custody since 06.09.2025 and they have no criminal antecedents, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned learned District Additional & Sessions Judge-IV, Banka in connection with Banka P.S. Case No. 393 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.
9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any
