2. The petitioner apprehends his arrest in connection with Alinagar P.S. Case No. 10 of 2025, registered for the offences punishable under Sections 126(2), 115, 64(1), 318(4), 351(2), 3(5) of the BNS.

3. The informant alleges that the petitioner, at the pretext of marriage, had physical relations with her for five years. Out of physical relations with the petitioner, she became pregnant. In presence of the Sarpanch, the marriage between the petitioner and the informant was solemnized on 08.01.2024. It is further alleged that the petitioner and his family members subsequently ousted her from the matrimonial house.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.31124 of 2025(4) dt.09-10-2025 2/2 that the informant is a married lady. She has two children, Thurren Praween and Md. Jamil @ Anis from her earlier husband Sheikh Munisul @ Md. Aftab. Sheikh Munisul @ Md. Aftab has sworn an affidavit stating that the informant is his legally wedded wife and that Thurren Praween and Md. Jamil @ Anis are his children. In that affidavit, Sheikh Munisul @ Md. Aftab has also mentioned that without divorce, the informant intercepting the petitioner wanted to solemnize marriage with him.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the petitioner after giving enticement and false promise of marriage, had physical relations with the informant.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Benipur, Darbhanga in connection with Alinagar P.S. Case No. 10 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) Nirmal/- U T
