The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 38(i), 41(i) of the Bihar Prohibition & Excise Act. There is recovery of 2624.565 litres of Indian Made Foreign Liquor from the truck. The name of the petitioner surfaced on the disclosure of Chowkidar. Learned APP appearing for the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that petitioner has five criminal antecedents of similar nature.

Considering the fact that petitioner is a habitual

Patna High Court CR. MISC. No.31027 of 2022(2) dt.04-11-2022 2/2 offender and he is accused in five other cases of similar nature. This Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected. Accordingly, the petition is disposed off with a liberty to the petitioner to surrender before learned Court below and pray for regular bail. The learned Court below may consider the prayer for regular bail of the petitioner, keeping in view the facts discussed above and without being prejudiced by the order of this Court.
