2. Following is the relief sought for in the present writ application :

"1. That this writ application is being

Patna High Court CWJC No.10968 of 2025(3) dt.06-05-2026 2/3 filed for the issuance of Writ of MANDAMUS, commanding the respondent authorities particularly respondent no. 2 to 4 to forthwith return the earnest money deposit amount (EMD) Rs 3,75000/- which was deposited against tender notice no 79 year 2019-2020 for construction of G+2 school building at Urdu Higher Secondary School, Amjhar Sharif, Haspura, Aurangabad, Group No SSS 1036, at serial no 7, but land or construction of above building has not been made available by the respondent authority and more than five years have passed and there is no possibility for availability of land.

AND, for issuance of appropriate Order or Orders, Direction or Directions for which the petitioner may be found entitled to."

3. Upon perusal of records, it appears that petitioner has made a representation vide Annexure-P/7 before the Executive Engineer (respondent No. 5) for redressal of his grievance, which is still pending consideration.

4. Considering the fact that the representation is still pending before respondent No. 5, the respondent No. 5 is directed to consider and dispose of the same by passing an appropriate order, in accordance with law, preferably within a period of eight weeks from the date of receipt/production of a copy of this order, after affording due opportunity of personal hearing to the petitioner.

5. With the aforesaid observation, the present writ application stands disposed of.
