The petitioner is apprehending his arrest in connection with Naubatpur P.S.Case no.452 of 2013 registered for offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is named it he FIR and there is allegation of firing by the petitioner and other co-accused persons on the deceased causing his death.

Submission of the learned counsel for the petitioner is that the informant is not eye witness of the occurrence. Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant

Patna High Court Cr.Misc. No.49058 of 2018 (2) dt.27-08-2018 2/2 anticipatory bail to the petitioner.

With the aforesaid observation, this application is dismissed.
