2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 331 ( 4 ), 305 (a) of BNS.

3 . As per the prosecution case , informant suspects that this petitioner along with other co-accused persons committed theft in the house of informant.

4. It is submitted on behalf of the petitioners that petitioner is co-villager of informant and he has falsely been made accused in this case only on the basis of suspicion . Neither any stolen article has been recovered from possession of petitioner nor he is connected with the alleged occurrence .

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Benipur in connection with Bahera P.S. Case No. 353 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
