2. The present writ petition has been filed for direction to the respondents to regularize the service of the petitioner under the department as the petitioner has engaged on daily wager.

3. Learned counsel for the State has filed a detailed counter affidavit stating therein that the petitioner was engaged as a daily wager employee with effect from 27.01.1988. Thereafter, the respondent no.3 has issued a letter vide memo no.5777 dated 04.04.1988 by which he had cancelled the letter dated 04.01.1988 by which the petitioner has been engaged as

Patna High Court CWJC No.14632 of 2012(3) dt.19-02-2024 2/2 daily wager employee and in view of the aforesaid it appears that the petitioner had worked only with effect from 27.01.1988 till 07.04.1988 i.e. 72 days only and the petitioner was neither appointed in regular established nor against the sanctioned post so his case cannot be considered in the light of State Government Circular.
