JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2018 The petitioner is apprehending his arrest in connection with Barbigha Police Station Case No. 97 of 2018, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 427, 353, 427 and 186 of the Indian Penal Code. Allegation against the petitioner is of blocking the road and creating nuisance during 'Bharat Band'.

Submission of learned counsel for the petitioner is large number of persons have been made accused in this case and no specific allegation has been attributed to the petitioner and he has falsely been made accused in this case and other co-accused having similar allegation has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order

Patna High Court Cr.Misc. No.48741 of 2018 (2) dt.25-08-2018 2/2 dated 18.05.2018 passed in Cr. Misc. No. 30616 of 2018. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of accusation as well as the fact that petitioner has criminal antecedent, as he is accused in one more case, I am not inclined to grant the privilege of anticipatory bail rather petitioner should surrender and make prayer for regular bail, which will be considered on its own merit.
