Learned counsel for the petitioners submits with reference to counter affidavit that the encroachment over the public road/land is admitted but no action was taken by the respondents for removal of encroachment over the public road/land.

Learned counsel for the respondents submits that they are in the process of removal of encroachment over public land. Considering the aforesaid, the writ application is disposed of with a direction to the Executive Officer, Nagar Parishad, Danapur, Patna to examine the claim of the petitioner as to encroachment over public road and after hearing the alleged encroacher, the Executive Officer, Nagar Parishad, Danapur, Patna shall take steps for removal of encroachment at the earliest preferably within a maximum period of three months from the date of receipt/production of a copy of this order. With the aforesaid, the present writ application stands disposed of.
