Sri P.N. Shahi learned senior counsel for the petitioners and Sri Binod Kumar Singh learned counsel for the private respondents have jointly made a submission which may put an end to the dispute between the parties and they have prayed that the land of the petitioners as well as a land of the private respondent nos. 7 and 8 may be measured and
Patna High Court CWJC No.14755 of 2016(5) dt.15-11-2022 2/2 demarcated as per the details given in their respective sale deeds.
The Circle Officer, Ekangarsarai, Nalanda is directed to measure the land and demarcate the same in accordance with details given in the sale deed of the parties. The measurement shall be made on a date convenient to both the parties and in presence of both the parties or their representatives. If the parties so desire they may have there own Amins/Survey Knowing Advocate Commissioner so that there is no dispute between them.
The exercise of measurement must be done within eight weeks from the date of communication of this order. Once the order is communicated to the Circle Officer, Ekangarsarai, it will be incumbent upon both the parties to approach him and a firm date fixed for measurement.
With the aforesaid observations and directions, this writ petition is disposed of.
