Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application for regular bail arises out of Teghra P.S. Case No. 105 of 2020, disclosing offence punishable under Sections 120-B of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
The petitioner is in custody since 04.06.2021. It has been asserted in the application that the petitioner has no criminal antecedent. As the prosecution story goes, on the basis of secret information, the police had conducted raid in the house
Patna High Court CR. MISC. No.40821 of 2021(3) dt.05-01-2022 2/2 of co-accused Ajay Sharma, leading to recovery of 1926.720 litres of illicit liquor. The petitioner's name has been mentioned in the FIR as one of those engaged in illegal trade of illicit liquor.
Learned counsel appearing on behalf of the petitioner has submitted that it is evident from the First Information Report that there is no recovery from the petitioner's possession and his implication is not supported by any concrete material. Considering the facts and circumstances and nature of accusation, as emerging from the FIR, in my opinion, a case for grant of regular bail is made out. This application is accordingly allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai, in Teghra P.S.
