The petitioner is in custody in connection with Rosera P.S. Case No. 61 of 2019 for the offence under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 08.03.2019. He further submits that in the instant case total 132 litres of foreign liquor was seized. He further submits that nothing was recovered from the conscious possession of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court CR. MISC. No.28120 of 2019(2) dt.29-04-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Samastipur in connection with Rosera P.S. Case No. 61 of 2019.
