Mr. Yogendra Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

Allegation against the petitioner is to have kidnapped and ravished to the victim girl. In reply to the court's question, the victim expressed her desire that the petitioner should be punished severely. She further disclosed that the petitioner threatens her as well as her parents.

In view of that statement, the claim of voluntary compromise of the case is not acceptable.

Considering the statement of the victim, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Bihta Police Station Case No. 202 of 2017

Patna High Court Cr.Misc. No.50541 of 2018(2) dt.10-12-2018 2/2 pending in the court of learned 1st Additional Chief Judicial Magistrate, Danapur, Patna. Hence, prayer for anticipatory bail is refused.

Petitioner may surrender before the court below and pray for regular bail.
