The petitioners seek Anticipatory bail in connection with Nabinagar P.S. Case No. 47 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 435, 353, 332, 333, 379, 427, 504/120 B of the Indian Penal Code. It has been submitted on behalf of the petitioners that although petitioners are named in the FIR, but there is general and omnibus allegation against petitioners. There is no specific overt act against these petitioners. The petitioner is only alleged to be a member of mob. It has been further submitted that similarly placed co-accused has been granted anticipatory bail
Patna High Court Cr.Misc. No.49255 of 2018(3) dt.10-09-2018 2/2 by this Hon'ble Court as contained in Annexure-3 and other similarly placed co-accused persons, namely Bijendra Paswan, Rajendra Pal and Shashi Singh have also granted anticipatory bail by this Hon'ble Court vide order dated 03.08.2018 passed in Cr. Misc. No. 39072 of 2018.
Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioners named above in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad, in connection with Nabinagar P.S. Case No. 47 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
