Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends her arrest in connection with Dariyapur P.S. Case No. 139 of 2020, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the informant has submitted that the process under Section 82 & 83 of the Cr.P.C. has been issued against the present petitioner as well as other co-accused

No.40592 of 2021(2) dt.09-02-2022 2/2 persons and considering this fact the anticipatory bail petition of the co-accused Abhay Kumar Singh and Ankit Kumar @ Ankit Kumar Singh was dismissed as not maintainable by this Court vide order dated 21.12.2021 in Cr. Misc No. 8997 of 2021. The learned counsel for the petitioner has submitted that some co-accused persons on similar allegation, have been granted anticipatory bail in Cr. Misc No. 5967 of 2021 & Cr. Misc No. 7410 of 2021 vide order dated 09.08.2021, but the process under Section 82 & 83 of the Cr.P.C. issued against the petitioners was not brought to the notice of the Court in those cases and it was the reason that some of the petitioners have been granted anticipatory bail.

Accordingly, the present bail application is dismissed as not maintainable.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
