2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Barahara P.S. Case No. 514 of 2022 dated 12.07.2022 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 337, 338, 332, 333, 427, 436 and 504 of the Indian Penal Code.

4. As per the prosecution case, the villagers of two villages were fighting each other and created riot like situation. When the informant along with other police personnel reached

Patna High Court CR. MISC. No.39707 of 2023(3) dt.08-11-2023 2/3 there and tried to pacify them, they were assaulted by the villagers. Some of the villagers set the shops on fire in the market.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner is accused in three other criminal cases as stated in para 3 of the bail petition. There is no specific overt act against the petitioner. The petitioner is only a member of mob. There is general and omnibus allegation against the petitioner. The other co-accused persons have already been granted bail by the Coordinate Bench vide order dated 17.03.2023 passed in Cr. Misc. No. 3436 of 2023.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Bhojpur at Ara in connection with Barahara P.S. Case No. 514 of 2022, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
