14-12-2021 Heard learned counsel for the parties.
The petitioner seeks bail in Lodipur P.S. Case No. 102 of 2019, registered for the offence under Section 302, 201, 120B of the Indian Penal Code.
As per the F.I.R., brother of informant had gone with this petitioner and other co-accused persons and later on, deadbody of brother of informant was found. It is further alleged that earlier, a sale-deed was executed by mother of co-accused Gaurav Kumar in favour of the deceased and due to this, there was some dispute between the parties and on account of which, the brother of informant was killed.
It is submitted on behalf of petitioner that only suspicion has been raised against this petitioner. Some of the other similarly situated co-accused persons have already been
Patna High Court CR. MISC. No.40554 of 2021(2) dt.14-12-2021 2/2 granted bail by this Court, vide orders annexed at Annexure 3 series and Annexure 4 series respectively. Petitioner is in custody since 25.01.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IXth, Bhagalpur in connection with Lodipur P.S.
