2. The present Cr. Misc. Application has been filed for quashing the order dated 02.08.2013 passed by the learned Judicial Magistrate 1st Class, Motihari, East Champaran, in connection with Complaint Case No. 1277 of 2012 whereby and whereunder the learned Trial Court took cognizance under Section 406 of the Indian Penal Code against the petitioner.

3. Learned counsel for the petitioner submits that the present application may be disposed of with liberty to the petitioner to take all the points, as raised in this petition, before the learned Trial Court at appropriate stage in accordance with law.
