JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 This application, for grant of anticipatory bail, arises out of Barauni (Gadhara) P.S. Case No. 407/2018, disclosing offences under Sections 414/34 of the Indian Penal Code.

That police on information that petitioner and others is living in the house of one Kamdeo Sharma and they have one stolen car through which they are doing illegal activities, raided, the house of Kamdeo Sharma and on seeing the police, three persons started fleeing away, however, one accused namely, Amit das was apprehended, who disclosed the names of petitioner and others and also recovered a Swift Dzire Car and on being asked, he could not produce the papers of the car. Apart from that he is accused in one more case.

No.28283 of 2019(4) dt.16-07-2019 2/2 Submission of learned counsel for the petitioner is that only on the basis of suspicion, he has been made accused in this case and nothing has been recovered from his house. Learned counsel for the State opposed the prayer for bail and submitted that the petitioner has kept the stolen vehicle for the purpose of illegal activities.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is, accordingly, dismissed.
