The petitioner is apprehending his arrest in connection with Rampur P.S.Case No.298 of 2017 , registered for offences punishable under Sections 414 and 413/34 of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the police on confidential informant intercepted three motorcycles and accused persons were arrested and in course of enquiry, they disclosed the name of the petitioner and also that one motorcycle has been given to the petitioner for selling the same and the key was also recovered from the house of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner was not present there and the key was not recovered

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
