JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-09-2024 Though the present writ petition has been filed for commanding the respondents, especially respondent no.3, i.e. the Director Bihar Nursing Council, Patna to register her with the Bihar Nursing Council, Patna, however, there is a dispute with regard to the institution, from where the petitioner has completed her ANM vocation, being recognized or not by the Indian Nursing Council, nonetheless, the learned counsel for the petitioner seeks to rely upon a judgment dated 04.01.2012, passed by a Co-ordinate Bench of this Court, in CWJC No.3998 of 2010 (Vijay Kumar & Anr. vs. the State of Bihar & Ors.) and prays that the Director Bihar Nursing Council,

Patna High Court CWJC No.3757 of 2016(3) dt.26-09-2024 2/2 Patna be directed to consider the case of the petitioner with regard to her registration, in light of the aforesaid judgment rendered in the case of Vijay Kumar & Anr. (supra).

2. Having regard to the facts and circumstances of the case, I deem it fit and proper to grant liberty to the petitioner to file appropriate representation before the respondent no.3, i.e. the Director Bihar Nursing Council, Patna, annexing a copy of the aforesaid judgment rendered in the case of Vijay Kumar & Anr. (supra), and in case such a representation is filed by the petitioner, within a period of four weeks from today, the same shall be disposed off by the respondent no.3, by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

3. The writ petition stands disposed off on the aforesaid terms.
