2. Petitioner seeks pre-arrest bail in connection with Marhowrah P.S.Case No.782 of 2023 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

3. As per the allegation made in the FIR, the deceased and co-accused Ajay Rai cooked fish and ate together and just next day, the deceased was found dead in the field. It is also alleged that 3-4 days ago, the petitioner had threatened the deceased to kill him.

4. Learned counsel appearing on behalf of the petitioner submitted that in no manner, the petitioner is concerned with the alleged murder and the specific allegation is

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. Having considered the rival submissions made on behalf of the parties, as well as, considering the nature of allegation made in the FIR, I am not inclined to enlarge the petitioner on pre-arrest bail.

7. However, the petitioner has stated that in no manner, he is concerned with the alleged murder of the deceased and the specific allegation is against one Raju Kumar.

8. In view of the above submissions made on behalf of the parties, I find it proper that the petitioner, if so advised, may file regular bail application before the learned district court. The learned district court is directed to hear the regular bail application of the petitioner on the same day it is filed on the basis of the materials available on the record and pass a reasoned order in accordance with law.

9. With the above observation/direction, the present bail application stands disposed of.
