JUSTICE SATYAVRAT VERMA ORAL ORDER 03-02-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 420, 409 and 34 of the Indian Penal Code read with Section 7 of E.C. Act. Learned counsel for the petitioner submits that petitioner is in custody since 27.03.2022 and is a person with clean antecedent. It is next submitted that petitioner is a PDS dealer and it has been alleged that grains were found loaded on a vehicle and the driver of the vehicle disclosed that the grain belongs to the petitioner which was being taken to Budhu Sah. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that the grains did not belong to his PDS and the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kahalgaon (Ghogha) P.S. Case No. 349 of 2021.
