In this case, the petitioner is seeking anticipatory bail in connection with Bariyarpur P.S. Case No. 89 of 2013, registered for the offence under Sections 364(A) of the Indian Penal Code.

Allegation of kidnapping has been made against the petitioner.

Learned counsel for the petitioner submits that other co-accused persons were faced the trial and all have been acquitted in this case. However, the victim in his statement recorded under Section 164 of the Cr.P.C. has taken the name of this petitioner to have brought him to the forest.

Patna High Court CR. MISC. No.28630 of 2019(2) dt.01-05-2019 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
