The petitioner seeks bail in Dighwara P.S. Case No. 187 of 2018 corresponding to Sessions Trial No. 652 of 2019, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. Later on, section 302 IPC was added. Lastly, the bail application of petitioner was rejected vide order dated 23.02.2021. From perusal of impugned order dated 21.03.2022, it appears that the case is likely to be concluded within a period of six months. Petitioner is in custody since 29.03.2019.
Considering the nature of accusation and stage of
Patna High Court CR. MISC. No.29741 of 2022(2) dt.06-07-2022 2/2 trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
However, trial court is directed to conclude the trial preferably within a period of twelve months.
