1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of regular bail, arises out of Main Police Station Case No. 68 of 2023, dated 31.05.2023, disclosing offences under Sections 341/323/324/307/504/34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 27.05.2023, while the informant, along with her son, Prince Kumar, was returning to her home after attending a marriage, they were intercepted by some persons and the son of the informant was assaulted by means of small pointed iron rod (raiti) on the backside of his head, due to which he sustained injury.
4. Learned counsel for the petitioner submits that the

No.40369 of 2024(2) dt.02-08-2024 2/3 petitioner is not named in the First Information Report, which has been lodged after delay of about three days from the date of occurrence. The statement of the son was recorded by the police, in which, he disclosed that one person, having long hair, assaulted him by means of raiti on the back of his head. Subsequently, the T.I. parade was conducted in the police station, in which, the petitioner was identified by the victim. Learned counsel further submits that the petitioner is having no criminal antecedent and he is in custody for about nine months since 31.10.2023. The T.I. parade was conducted in the police station and not in the jail as per the manual. There is no likelihood that the petitioner will abscond and/or temper with the evidence.

Regards being had to the submissions made by the parties and taking into consideration that the petitioner is in custody since 31.10.2023, he is having no criminal antecedent and there is no likelihood that the petitioner will abscond and/or temper with the evidence, I am inclined to grant regular bail to the petitioner.
6. This application is, accordingly, allowed.

Patna High Court CR. MISC. No.40369 of 2024(2) dt.02-08-2024 3/3 furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate-IV, Gaya, in connection to the Main Police Station Case No. 68 of 2023.
