The petitioner seeks bail in Rupaspur P.S. Case No. 66 of 2021, registered for the offence under Section 386 of the Indian Penal Code.

As per the F.I.R., Rs. Fifteen Lacs, as extortion money, was demanded from Mobile no. 9430899349 with threatening to kill the son of informant.

It is submitted on behalf of petitioner that aforesaid mobile number does not belong to the petitioner. In fact, during course of investigation, in connection with Budha Colony P.S. Case No. 34 of 2021, name of petitioner was transpired with the same allegation and in paragraph - 23 of the case diary, it has come that said mobile phone was sold by this petitioner to one Govinda Kumar prior to the alleged occurrence and as such, the

Patna High Court CR. MISC. No.40549 of 2021(2) dt.14-12-2021 2/2 mobile in question does not belong to this petitioner. Petitioner is in custody since 10.03.2021. Chargesheet has been submitted. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur (Patna) in connection with Rupaspur P.S.
