The petitioner seeks bail in C.I.S. No. 301/2019/ Nabinagar P.S. Case No. 55 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Excise and Prohibition Act, 2016.
Counsel for the petitioner submits that there is no recovery of illicit liquor from possession of the petitioner. Allegation against the petitioner is that he was going as liner of Indica Car. There is specific allegation against co-accused Rahul Kumar who was driving Indica Car, from which, huge quantity of foreign liquor and Rs.32,200/- has been recovered. Petitioner was only liner of the aforesaid car.
Patna High Court CR. MISC. No.28307 of 2019(2) dt.01-05-2019 2/2 Petitioner is in custody since 13.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum Special Judge (Excise), Aurangabad, in connection with C.I.S.
