2. The petitioner is apprehending arrest in connection with Dholbazza P.S. Case No. 62 of 2022 lodged on 23.07.2022, for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 333, 337, 353, 354, 188, 427, 309, 436 & 504 of the Indian Penal Code pending in the Court of Judicial Magistrate 1st Class, Naugachia, Bhagalpur.
3. As per the prosecution, FIR has been lodged against 20 named accused persons including the present petitioner and 30 unknown persons against whom there is an allegation that they have obstructed the government work and pelted stones on
Patna High Court CR. MISC. No.30431 of 2025(2) dt.15-05-2025 2/3 the police party due to which some of them were injured and subsequently, sent to the hospital for treatment.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner is a lady and she has falsely been implicated in this case. Counsel submits that there is no specific allegation against the petitioner. Counsel further submits that petitioner has no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the present case has been registered against petitioner and other accused persons for the offence of deliberately obstructing government work by gathering men and women and assaulting the deployed magistrates, police officers, and police force, causing them injuries.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected.
7. However, if petitioner surrenders before the Trial Court within a period of six weeks from today, then in that case, the Trial Court is directed to pass order on her surrender-cumbail application on the same day without being prejudice that the
