JUSTICE PARTHA SARTHY ORAL ORDER 12-11-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Begusarai Muffasil P.S. Case No. 241 of 2020 registered under sections 302, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per allegation in the FIR, while the informant was coming back home along with his brother, the brother of the informant was shot dead by Ramnath Kumar and two other persons.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in course of investigation. It is further submitted that even in his

No.25719 of 2020(3) dt.12-11-2020 2/2 further statement, the informant has named Pintu Kumar and Mansoor Kumar as the other two assailants and the petitioner along with others have been named by the informant as being involved in the murder of his brother. The petitioner has no criminal antecedent, he is in custody since 20.5.2020 and the investigation in the case is concluded.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the material that has transpired in course of investigation together with the investigation having concluded, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Begusarai Muffasil P.S. Case No. 241 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees ten thousand) only with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
