1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The present quashing application has been filed seeking quashing of the order dated 15.04.2023 passed by the learned Additional District and Sessions Judge-XVII, Bhojpur, Ara in S.Tr. No. 214 of 2021 whereby the petition dated 28.03.2023 filed on behalf of the prosecution seeking a direction for producing the treatment register dated 21.02.2021 of the deceased from Jagdishpur Referral Hospital has been allowed.

3. Learned counsel for the petitioner, after arguing vehemently, seeks permission to withdraw this application with liberty to raise all the issues raised in the present quashing application at an appropriate stage in the trial.

4. Permission is accorded.
