Let the defects, as pointed out by the office, be removed within four weeks of start of normal functioning of the physical court.

Petitioner seeks bail in connection with Katoriya P.S. Case No. 112 of 2020 corresponding to S.T. No. 10 of 2021 registered for the offences punishable under Sections 304(B), 201 of the IPC.

Patna High Court CR. MISC. No.41281 of 2021(5) dt.02-03-2022 2/3 sister was married with petitioner five years ago and on account of non-fulfillment of demand of motorcycle, he used to assault her. On the alleged date of occurrence, the petitioner having tied her sister with a tree assaulted her and in the next morning dead body of the deceased was found 50 metre away from the petitioner's house from the bush.

Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case only on the basis of suspicion. He further submits that petitioner is husband of the deceased and he is in custody since 04.06.2020.

The learned Additional Public Prosecutor on the basis of material on record as well as case diary vehemently opposed the prayer of bail. He summits that there is direct allegation of assault against the petitioner and the dead body of the deceased was recovered about 50 metre away from the house of the petitioner from the bush. He further submits that it appears from the postmortem report that multiple injuries were found on the body of the deceased.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail and accordingly, his prayer for bail stands rejected.
