JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-08-2018 This application has been filed for modification of the order dated 20.11.2017 passed in Cr.Misc.No.55106 of 2017 whereunder this petitioner and one Suresh Prasad were granted anticipatory bail.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 20.11.2017 passed in Cr.Misc. No.55106 of 2017 the petitioner and one Suresh Prasad were ordered to be released on bail, in the event of their arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bagaha, West Champaran, in connection with Bagaha P.S.Case No.493 of 2015, subject to the condition as laid down

Patna High Court Cr.Misc. No.53023 of 2018 (2) dt.29-08-2018 2/2 under Section 438 (2) of the Cr.P.C. but due to illness the petitioner could not surrender before the trial court in time. Learned counsel further submits to extend four weeks' further time for surrender of the petitioner no.1 by modified order dated 20.11.2017 passed in Cr.Misc. No.55106 of 20.11.2017. For the reasons assigned in the present petition, the period of surrender of the petitioner no.1of the order dated 20.11.2017 is extended by further four weeks from today. Accordingly, order dated 20.11.2017 passed in Cr.Misc. No.55106 of 2017 is modified to the extent stated above. The modification application is, accordingly, disposed of.
