Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406 / 420 of the Indian Penal Code.

As per the prosecution case, this petitioner executed an agreement to sell a piece of land in favour of informant on 03.10.2018 and after execution of sale-deed, the informant paid money to the petitioner, but later on, when the informant came to know that the land is disputed, he demanded his money back from the petitioner, which he refused to return him (informant).

Patna High Court CR. MISC. No.40299 of 2021(5) dt.30-06-2022 2/3 Learned counsel for the petitioner submits that petitioner is ready to deposit an amount of Rs. 25,00,000/- (twenty five lacs) in three equal installments, subject to withdrawal of the case by the informant.

Considering the aforesaid facts & circumstances and in view of undertaking given by the petitioner that he is ready to return the amount in installments, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, above named, be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate - 4th, Patna City, Patna in connection with Didarganj P.S. Case No. 268 of 2020, subject to condition that petitioner shall deposit Rs. 10,00,000/- (ten lacs) within one month from today and thereafter deposit the remaining amount i.e. Rs. 15,00,000/- (Fifteen lacs) in three equal installments i.e. Rs. 5,00,000/- (five lacs) each installment within a period of nine months thereafter. If the petitioner fulfills the condition, as aforesaid, the provisional bail granted to the petitioner shall be confirmed by the learned court below and if the petitioner fails to do so, the court below shall cancel the bail bonds of
