JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 30-09-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual court proceedings. Since the physical court proceeding is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioners undertakes to remove the defects as pointed out by the office within three weeks of normal functioning of the court, failing which the office is directed to place the matter before the Bench. This application has been filed for modification of

Patna High Court CR. MISC. No.25287 of 2020(4) dt.30-09-2020 2/2 the order dated 24.02.2020 passed in Cr. Misc. No. 87508 of 2019 for extension of time for surrender.

Learned counsel for the petitioners submits that the petitioners have been granted bail on 24.02.2020 passed in Cr. Misc. No. 87508 of 2019, but these petitioners were out of State to earn their livelihood, they could not surrender within the stipulated period.

Considering the same, let the period of surrender of the petitioners be extended by six weeks from today, in connection with Case No. 80C2/2009 to the satisfaction of the learned C.J.M., Lakhisarai.

Rest of the condition as stipulated in the order dated 24.02.2020 shall remain as it is.

Accordingly, the modification is allowed.
