JUSTICE BIRENDRA KUMAR ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,504,307/34 of the Indian Penal Code.

The petitioner is full brother of the informant. Allegation is that for land dispute, he assaulted with Farsa causing injury at the head of the wife of the informant. Submission is that the Doctor has found simple injury. There is case and counter case.

Since the petitioner had knowledge that his act might cause death, hence, I am not inclined to enlarge the petitioner on anticipatory bail.

Patna High Court Cr.Misc. No.49195 of 2018 (2) dt.24-09-2018 2/2 Accordingly, prayer is refused in connection with Dinera P.S.Case No.188 of 2017 pending in the court of learned S.D. J.M., Bikramganj, Rohtas.

Petitioner may surrender within three weeks.
