2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Jamui P.S. Case No. 696 of 2024 registered for the offence under Sections 126(2), 115(2), 109, 140(3) and 3(5) of the Bharatiya Nyaya Sanhita.

3. According to the case of prosecution, it alleged that on the date of incident, the present applicant along with other co-accused persons committed Mar-Pit with the informant due to that he sustained injuries on his body. On the basis of information given by him, the offence has been registered.

4. It is submitted by the learned counsel for the petitioner that petitioner is innocent and has falsely been

Other named co-accused person namely Pawan Yadav has already been granted regular bail by the Trial Court itself and named accused Nitish Kumar has already been granted regular bail by the Co-ordinate Bench of this Court vide its order dated 07.05.2025 passed in Cr. Misc. No. 28906 of 2025. Lastly, he submits that the injuries sustained by the victim are of the simple nature, therefore, prima facie the said offence is not made out against the petitioner. Therefore, on these grounds, it is prayed that the petitioner may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

7. Perused the case diary and other materials available on record.

8. Considering the submissions made by the counsel for the petitioner and particularly considering the fact that the other co-accused persons Pawan Yadav and Nitish Kumar have already been granted benefit of regular bail, I am of the view that it is a case where the petitioner should be granted benefit of bail.

9. Accordingly, the application is allowed.

10. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Jamui in connection with Jamui P.S. Case No. 696 of 2024.
