The petitioner seeks bail in RC Case No. 15(S)/18 corresponding to Special Case No. 01 of 2020, registered for the offence punishable under Sections 120(B), 409, 420 of the Indian Penal Code and section 13(2) r/w section 13(1)(c) and (d) of the Prevention of Corruption Act.

This case relates to Srijan scam.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Petitioner at the relevant time was Branch Manager of Bank of Baroda. Only allegation against this petitioner is that he opened bank account of Block Development Officer, Pirpainti, Bhagalpur. Similarly situated co-accused have been granted bail by this Court. One of

Patna High Court CR. MISC. No.40589 of 2021(2) dt.16-12-2021 2/2 the chargesheeted accused Sarita Jha has been granted bail by this Court vide order dated 12.07.2021 passed in Cr. Misc. No. 4974 of 2021. Petitioner is in custody since 14.08.2019 and later on, remanded in this case on 31.01.2020 and he has remained in custody for approximately two years in the judicial custody. Investigation is complete.

However, counsel for the CBI opposed the bail application and submitted that there is sufficient oral as well as documentary evidence against the petitioner.

Considering the period of custody and the fact that similarly situated co-accused have been granted bail by this Hon'ble Court, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, CBI II, Patna in connection with RC Case No. 15/S/18 corresponding to Special Case No. 01/20.
