2. The petitioner apprehends his arrest in connection with Complaint Case No. 1347 of 2023, registered for the offences punishable under Sections 147, 148, 341, 323, 325, 498A, 308, 504, 506/34 of the IPC.

3. As per allegation, marriage of the complainant was solemnized with the petitioner with Hindu rites and rituals and two children were born out of their wedlock. It is further alleged that the petitioner along with other co-accused persons started demanding dowry and on non-fulfillment of the same, she was assaulted and ultimately ousted her from her matrimonial house.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. It has further been submitted that as a matter of fact, the complainant developed love and affection with one, Vimal Kumar Paswan that is why she is not residing with the petitioner. She has build a house on the land purchased by the petitioner in her name. Their two children are still residing with the petitioner.

5. On the other hand, the learned counsel for the informant as well as State has opposed the prayer for anticipatory bail of the petitioner by submitting that the complainant constructed house on the land which was purchased by herself.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Complaint Case No. 1347 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.
