The petitioner seeks bail in Khodawanpur P.S. Case No. 229 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.
As per the prosecution case, four unknown criminals riding on motorcycle stopped the pick-up van of informant, assaulted him with fist and legs, snatched mobile phone and fled away with his pick-up van.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Vikash Kumar and Pappu Yadav. No looted article has been recovered from possession of this petitioner. Petitioner has not been put on test
Patna High Court CR. MISC. No.40560 of 2021(2) dt.16-12-2021 2/2 identification parade till date. Petitioner is in custody since 25.02.2021. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawanpur P.S.
