The petitioner seeks bail in Sirdalla P.S. Case No. 276 of 2020, registered for the offence punishable under Section 395 of the Indian Penal Code.

As per the prosecution case, while the informant was returning to his home by car, on the way, 15-16 persons having armed with lathi, pistol intercepted the vehicle and looted cash and mobile from possession of informant.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Tauquir Sah who has been granted bail by this Court vide order dated 04.10.2021 passed in Cr. Misc. No. 27449 of 2021. No looted

Patna High Court CR. MISC. No.40413 of 2021(2) dt.16-12-2021 2/2 article has been recovered from possession of this petitioner. Petitioner has not been put on test identification parade till date. Similarly situated co-accused persons have been granted bail by this Court vide order dated 21.09.2021 passed in Cr. Misc. No. 20554 of 2021, dated 02.09.2021 passed in Cr. Misc. No. 22462 of 2021 Petitioner is in custody since 14.08.2020. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Nawada in connection with Sirdalla P.S. Case No. 276 of 2020.
